Definitions
In this Privacy Statement:
any reference to ‘Jarrod Barnes Photography’, ‘us’, ‘we’ or ‘our’ means Jarrod Barnes Photography Pty Ltd ACN 622 576 185;
Recipient means an individual that receives one of our products or services (by making an online Print Store purchase, by booking a Visual Content Service directly with one of our team members or by submitting an New Enquiry or Visual Content Brief);
Personal Information means any information relating to an identified or identifiable natural person and includes both Device Information, Form Information and Order Information.
Jarrod Barnes Photography is committed to providing quality products and services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and billing information.
This Personal Information is obtained in many ways including correspondence, by forms, by telephone and email, via our website www.jarrodbarnes.com, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our products and services to you, providing information to our service providers involved in delivering your products and services and for marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
When we collect Personal Information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:
For the primary purpose for which it was obtained
For a secondary purpose that is directly related to the primary purpose
With your consent; or where required or authorised by law.
Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

How do we collect non-Personal Information?
When you visit our website, we collect non-Personal Information from you including, without limitation, which sections of the website are most frequently visited, how often and for how long. This data is always used as aggregated, non-Personal Information. We may analyse this non-Personal Information and release it to third parties in an aggregated form.
How do we collect Personal Information?
Like many websites, when you visit www.jarrodbarnes.com, we automatically collect certain information through the use of “cookies”, web beacons, device identifiers, pixels and other technologies including information about your web browser, IP address and time zone. Additionally, as you browse the website, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the website and information about how you interact with the website. credit card information (we don’t have access to your actual credit card details and we don’t store your credit card details as this information is handled by our payment gateway);

Recipient’s delivery address,

When you submit a visual content briefing form or book a service with us directly via correspondence, we collect the following information (which includes Personal Information) from you:
your name;
secondary contact name (if applicable);
agent / 3rd party contact name(s) (if applicable);
email address(es);
phone number(s);
site/location addresses;
any additional information relating specifically to the visual content service provided
How do we use Personal Information?
We use the Personal Information that we collect to fulfil any visual content services requested or any orders placed through the website (including processing your payment information, arranging for shipping and providing you with invoices and/or order confirmations). Additionally, we use this Personal Information to:
communicate with you;
communicate with secondary contacts / agents / 3rd party contacts regarding production requirements/logistics;
communicate with the Recipients to troubleshoot any production / order delivery problems;
screen our orders for potential risk or fraud; and
when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to:
screen for potential risk and fraud;
improve and optimise our website (for example, by generating analytics about how our customers browse and interact with the website and to assess the success of our marketing and advertising campaigns); and
to recognise you across different services and devices.
You may at any time refuse to provide the Personal Information that we request. However, this may limit or prohibit our ability to provide our products and services to you. You may withdraw your consent for us to process your Personal Information at any time by contacting us in accordance with our ‘Contact’ section.
Who do we disclose Personal Information to?
Outside of authorised personnel employed by us, we only share your Personal Information with third parties that meet the data privacy conditions described in this Privacy Statement.
These third parties help us use your Personal Information, as described above, and include:
our dedicated printing and framing supplier, for the production of our product;
logistics providers, so that we can fulfil our delivery service;
product tracking and marketing platforms, communications platforms and contractors who we engage to help process Personal Information and other data;
government third parties, including government agencies, regulatory bodies and law enforcement agencies as required, authorised or permitted by law; and
a third party that acquires or intends to acquire Jarrod Barnes Photography or its assets.
Security of Personal Information
We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it (including encryption and password protection). Each of our employees is aware of our security policies, and your information is only available to those employees who need it to perform their jobs. However, no method of transmission over the Internet using industry standard technology is 100% secure. Therefore, we cannot guarantee the absolute security of your information.
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.
Data Retention
When you place an online Print Store order or submit a briefing form, we will maintain your Personal Information, and the order information you have provided, for our records because we need this information to operate the accounts you have with us, to deliver our products and services to you and for the other purposes set out in the ‘How do we collect Personal Information?’ section. We will retain this information unless and until you ask us to delete this information.
Access to your Personal Information
You may access, review, update, rectify or delete your Personal Information by contacting us. We will respond to all written requests within 30 days. Please note that deleting your Personal Information may limit our ability to provide the service to you. We may limit or reject your request in certain cases, including without limitation where the burden or expense of providing access would be disproportionate to the risks to your privacy in the case question, where the rights of other persons would be violated or as required by law. If you need further assistance regarding your access and control of your Personal Information, please contact us.
Jarrod Barnes Photography Pty Ltd will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.
To protect your Personal Information, we may require identification from you before releasing the requested information.
Maintaining the Quality of your Personal Information
It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up to date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
